General Terms and Conditions
The present General Terms and Conditions are the contractual foundation of all legal transactions between RedNetwifi, Calle Maiquez 3 - 1, Cehegin 30430, Murcia, Spain, and the Customer regarding the provision of the RedNetwifi service and related services and performances.
1. How to order
1.1. The customer shall, at the prices and rates valid at the time, select the desired services. By placing the order, the customer shall at the same time recognize the present General Terms and Conditions which he may inspect at any time.
1.2. RedNetwifi expressly reserves the right to refuse to accept an order.
1.3. RedNetwifi reserves the right to alter the substance of any agreement and/or these General Terms and Conditions, including prices and rates, at any time. It shall notify the customer at least 30 days before the planned alteration takes effect. The customer shall be deemed to have agreed unless he objects to the change in writing within 30 days of its announcement. Where a customer objects to an alteration RedNetwifi reserves the right to terminate the contractual relationship.
2. Fees and terms of payment
2.1. Installation charges to be paid by cheque or direct bank transfer seven days prior to delivery or cash on the day of delivery.
2.2. Rental shall be payable in advance by direct debit starting on the day of installation. We will then collect payments on a monthly basis.
2.3. If the customer gets into arrears with the payments for a period of two consecutive months or an amount equal to the sum of two monthly rental fees, RedNetwifi will be entitled to disconnect the service and terminate the contractual relationship without notice. A fee of 90€ + IVA plus all outstanding arrears will be charged for the reinstatement of the service.
2.4 A charge of 7€ will be made in respect of direct debits that are not honoured and are then re submitted.
2.5. All materials delivered at the customers request shall remain the property of RedNetwifi until fully paid for by the customer.
3. Availability, interference with performance.
3.1. RedNetwifi will endeavor to provide the broadband service to you at the speed you have requested, however we cannot always guarantee this and the speed of your connection and download times may be slower if our network or the internet is congested.
3.2. RedNetwifi cannot guarantee to provide you with a fault free service but we shall endeavour to promptly remedy any interference with the service.
3.3. The performance of the RedNetwifi service and the prices charged are geared to the needs of private households and not for commercial use.
3.4. In an effort to ensure fair access to our service for all our customers RedNetwifi reserves the right to manage customer traffic across its network. This may involve restrictions to the customer's service including, but not limited to, reduced connection speed and restriction of 'peer to peer' downloading (see fair usage section on www.rednetwifi.com. These restrictions maybe used singularly or in conjunction with others. RedNetwifi reserves the right to deploy network traffic management measures at anytime and without notice.
3.5. The download limit for all users is one gigabyte per month. Exceeding this limit will result in a reduced service. Additional download capacity may be purchased. Contact RedNetwifi for further details.
3.6. We may suspend the broadband service from time to time without notice to you where it is necessary for us to do so for operational reasons such as repair, maintenance, improvement or emergency. We will restore the broadband service to you as soon as possible.
3.7. Due to the nature or the internet RedNetwifi cannot guarantee the quality of Voice Over IP (VOIP) telephone services such as Skype and other similar programs. RedNetwifi cannot to be held responsible for the costs of using VOIP services
4 Warranties and liabilities
4.1. RedNetwifi warrants that the hardware supplied by it is clear of defects when delivered. Any defects encountered shall immediately be communicated to RedNetwifi by the customer. The customer shall provide RedNetwifi with all particulars reasonably required to identify the defect and its causes. If the given claim is not covered by a warranty, RedNetwifi shall provide its services against payment, in particular reserving the right to charge the customer for any costs associated with the scrutiny of the returned goods. Excluded from any warranty are in particular such defects as are due to improper use, installation and/or commissioning by the customer or third parties. RedNetwifi does not warrant that the hardware supplied by it is capable of inter-acting with other hardware products not sold by it.
4.2. The warranty period for hardware is 12 months from date of receipt.
4.3. RedNetwifi does not accept any liability for the loss of data, other indirect or consequential damage and loss of profit.
4.4. RedNetwifi does not assume any liability for weather-conditioned impairments of the wireless-based RedNetwifi services nor for the quality of data transmission, for access times, potential restrictions on access to terrestrial or satellite-operated networks and/or servers linked to the Internet. To the extent that RedNetwifi enlists the services of third-parties (sub-contractors) for the provision of RedNetwifi services, it shall not be liable for any impairment within their scope of activities except to the extent, that such sub-contractors would be liable by law.
4.5. RedNetwifi will not be liable for any failure to deliver the broadband service or for any breach of contract, where the failure or breach is due to a reason outside of our reasonable control.
5. Duties of the customer
5.1. The customer undertakes to provide, when ordering the Service, complete and accurate particulars.
5.2. The customer's attention is expressly drawn to the fact that data transmitted via the Internet may be unprotected, which is why all necessary precautions to make the transmission of his data as safe as possible and to protect his PC against potential attacks by third parties via the Internet must be taken. The customer shall be solely responsible for the consequences of any potential unlawful use of data he has transmitted via the Internet. RedNetwifi is not liable for any damage to devices or data of the customer sustained in the context of his connection to the Internet.
6. Term and termination of the agreement
6.1. The duration of the present contract will be a minimum of 12 months and will be renewed for an equal time limit unless otherwise advised by the client giving at least one month notice in advance of the date of its expiration. After the first 12 months the client may cancel the contract provided that the client communicates this decision to RedNetwifi with a month's notice of the date in which he wishes to end said contract.
7. Data protection
RedNetwifi guarantees that all the personal data collected will be used only for information and will not be passed on to any third party, complying with the constitutional law 15/99, of December 13, of Personal Character Data Protection (LOPD).
8. Enlistment of third-party services
8.1. RedNetwifi reserves the right to enlist the services of third parties for the fulfilment of its contractual obligations
